Welcome to HeatherSmithMusic.com. This website is owned and operated by Heather Smith Music, a ministry dedicated to glorifying God through Christ-centered music and merchandise. By accessing or using our website, placing an order, or creating an account, you agree to be bound by these Terms of Service and all applicable laws.
1. Use of the Site
You agree to use this website only for lawful purposes and in a manner consistent with biblical principles of honesty, kindness, and respect. Prohibited activities include, but are not limited to:
- Attempting to copy, reproduce, or sell digital music files or copyrighted content without permission
- Posting obscene, blasphemous, threatening, or harassing content
- Interfering with the operation of the site (hacking, viruses, etc.)
- Using the site for commercial purposes unrelated to purchasing our products
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, especially if we believe behavior violates Scripture or harms the ministry.
2. Intellectual Property
All content on HeatherSmithMusic.com—including music, lyrics, artwork, photographs, videos, and text—is the property of Heather Smith or its licensors and is protected by U.S. and international copyright laws.
- Purchasing a CD or digital download grants you a limited, non-transferable license for personal, non-commercial use only.
- You may not distribute, perform publicly (outside of worship settings), broadcast, or create derivative works from our music without written permission.
- Sharing login credentials or downloaded files constitutes copyright infringement and theft, which dishonors the Lord who gives all good gifts (James 1:17).
3. Account Responsibility
When you create an account, you agree to provide accurate information and keep your password secure. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
4. Orders and Payment
- All prices are in U.S. dollars and subject to change without notice.
- We reserve the right to refuse or cancel any order for any reason, including pricing errors or suspected fraud.
- Placing an order constitutes an offer to purchase; acceptance occurs when we ship the product or deliver digital content.
- You represent that you are of legal age or have parental permission to make purchases.
5. Digital Downloads
Digital music files are delivered instantly upon successful payment. Due to the nature of digital products, all sales are final—no refunds or exchanges once the download link has been accessed.
6. Limitation of Liability
Heather Smith Music provides products “as is.” To the fullest extent permitted by law, we disclaim all warranties and shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid for the product in question.
We pray over every order and strive for excellence, but we are not liable for delays caused by shipping carriers, acts of God, or circumstances beyond our control.
7. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Tennessee and the United States, in harmony with the Word of God where possible. Any dispute arising from use of this site or purchases shall first be addressed through good-faith Christian mediation. If unresolved, disputes will be settled in the state or federal courts of Tennessee.
8. Changes to Terms
We may update these Terms at any time. Continued use of the site after changes constitutes acceptance of the new terms. The current version is always posted on this page.
